EU New Battery Regulation (EU) 2023/1542

How the scope changed after the new regulation replaced the old directive

(EU) 2023/1542 replaces the original Battery Directive 2006/66/EC, expands the definition of "battery" into five categories, and folds producer responsibility, conformity assessment and digital information into a single instrument. The five categories are portable batteries, starting, lighting and ignition (SLI) batteries, light means of transport (LMT) batteries, electric vehicle batteries and industrial batteries. The old directive mainly governed heavy metal limits and marking; the new regulation writes carbon footprint, recycled content, battery passport and due diligence into the list of obligations.

Two points affect Chinese exporters most directly. First, whenever a battery enters the EU market with a product, the responsible party is the one placing it on the market—importer and overseas manufacturer responsibilities are leveled. Second, the regulation takes the "time of placing on the market" as the trigger, not the production date, so old stock is equally bound. Compliance scheduling must be worked backward from shipping rhythm, not forward from R&D milestones.

When carbon footprint declarations and labels take effect

Carbon footprint is mandatory in category batches: electric vehicle batteries first, LMT batteries next, then industrial and portable batteries—and the declaration must come before the label. Electric vehicle batteries are the first mandatory object for carbon footprint declarations, LMT batteries follow, and industrial batteries (above the capacity threshold) and portable batteries are included in later stages. Labeling comes after the declaration, and the label must show the carbon footprint class and traceability information.

In practice, the carbon footprint is not self-calculated and self-declared. The declaration must be based on EU-recognized methodology and life-cycle data, with third-party verification attached. Qualified third-party laboratories can support data verification and validation, but the methodology must align with EU requirements. The common bottleneck for Chinese companies is incomplete electricity emission factors and supply chain data sources; we recommend building energy consumption and material ledgers by plant and by production line in advance.

What data the battery passport requires and who generates it

The battery passport is a type of digital product passport that provides key battery life-cycle data via a QR code carrier, and the economic operator placing the battery on the market is responsible for creating and maintaining it. Passport data includes battery identity information, material composition, carbon footprint, recycled content, performance and durability parameters, and dismantling and safety information. Electric vehicle batteries, LMT batteries and industrial batteries above the capacity threshold are the first objects.

The passport is not a one-off document but a data record that must be continuously updated and accessible to regulators and downstream users. Companies need to establish a unique battery identifier and data storage mechanism, and ensure consistency with the accompanying label and instructions. For exporters, the most easily overlooked point is the "data responsible party"—who issues the passport and who updates it after battery reuse or remanufacturing must be written clearly into contracts.

How the recycled content minimum ratios are calculated

Recycled content requirements target industrial batteries, electric vehicle batteries and SLI batteries, setting minimum ratios separately for cobalt, lead, lithium and nickel, raised in phases. The calculation basis is the share of recycled metals in active materials, supported by supply chain traceability and documentary evidence; it cannot be converted from total pack weight. Companies must obtain recycled metal source and ratio declarations from material suppliers and retain the calculation process in the technical file.

Recycled content and carbon footprint share supply chain data, so it is advisable to combine them into a single data collection exercise. If a supplier cannot provide a verifiable recycled ratio, that batch cannot complete the declaration, which in turn affects the integrity of the passport data.

Where the requirements differ for power banks, energy storage and EV batteries

The three product types fall into different battery categories with different mandatory items and timelines; one plan cannot cover all of them. Power banks are generally classified as portable batteries, where the core is heavy metal limits, marking and later-stage carbon footprint/passport obligations; energy storage systems are mostly industrial batteries, where the capacity threshold determines whether carbon footprint and passport apply; EV batteries have the fullest set of mandatory items, with carbon footprint, recycled content and passport all covered from the first batch.

Scheduling advice: work EV battery projects backward from the strictest milestone; for energy storage projects, first confirm whether capacity crosses the threshold; for power banks, complete marking and documentation compliance first, then follow up on digital information. Our laboratories can handle battery safety, performance and transport-related testing, and support preparation for carbon footprint and recycled content data verification.

Frequently Asked Questions

If a battery is exported inside a finished device, is the device maker or the battery maker responsible?

Responsibility lies with the party placing the product on the EU market, usually the importer or the overseas manufacturer; the device maker and battery maker must specify in contract who issues the declaration of conformity and who maintains the battery passport data.

Can a self-calculated corporate report be used for the carbon footprint declaration?

No. The declaration must be based on EU-recognized methodology with verification attached; a self-calculated report can only serve as an internal data basis and cannot replace the compliance declaration.

What needs to be prepared before the battery passport goes live?

First establish a unique battery identifier and data ledger covering material composition, carbon footprint, recycled content and dismantling information, and designate the parties responsible for issuing and updating the data.

Can old inventory still be sold after the new regulation takes effect?

The trigger is the time of placing on the market; batteries placed on the market after entry into force must meet the corresponding obligations, and an earlier production date is not an exemption.
